Alternative Dispute Resolution
1) Scope of Application
1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) of youngle Ltd. (hereinafter referred to as “Seller”) apply to all contracts for the supply of goods that a consumer or entrepreneur (hereinafter referred to as “Customer”) concludes with the Seller regarding the goods presented by the Seller in its online shop. The inclusion of the Customer’s own terms and conditions is hereby rejected, unless otherwise agreed.
1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
1.3 An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity acting in the exercise of its commercial or independent professional activity when concluding a legal transaction.
1.4 Depending on the Seller’s product description, the subject matter of the contract may be either the one-time delivery of goods or the recurring delivery of goods (“subscription contract”). In a subscription contract, the Seller undertakes to deliver the goods owed under the contract to the Customer at the agreed intervals for the duration of the agreed term.
2) Conclusion of Contract
2.1 The product descriptions in the Seller’s online shop do not constitute binding offers but serve for the Customer to submit a binding offer.
2.2 The Customer may submit the offer via the online order form integrated into the Seller’s online shop. By completing the electronic order process and clicking the button that finalizes the order, the Customer submits a legally binding offer for the goods in the shopping cart.
2.3 The Seller may accept the Customer’s offer within five days by:

sending the Customer a written or electronic order confirmation (via fax or email),

delivering the ordered goods (receipt decisive), or
-
requesting payment from the Customer after placing the order.
The contract is concluded at the time one of these events first occurs. If the Seller does not accept the Customer’s offer within five days, the offer is deemed rejected, and the Customer is no longer bound by their declaration of intent.
2.4 When selecting a PayPal payment method, the transaction is processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, under PayPal’s terms and conditions (link). If the Customer uses PayPal without an account, PayPal’s conditions for payments without an account apply (link). By selecting a PayPal payment method, the Seller immediately accepts the Customer’s offer when the Customer clicks the final order button.
2.5 When selecting “Amazon Payments,” payment is processed via Amazon Payments Europe s.c.a., 38 avenue John F. Kennedy, L-1855 Luxembourg (terms). By selecting “Amazon Payments” and clicking the final order button, the Customer simultaneously authorizes Amazon to process the payment, and the Seller accepts the offer at that time.
2.6 The contract text is stored by the Seller and sent to the Customer after order submission (by email, fax, or letter). If the Customer has created an account, order details are archived and accessible via the Customer’s password-protected account.
2.7 Before submitting the order, the Customer can identify and correct input errors using standard browser tools (e.g., zoom function). Changes can be made until the final order button is clicked.
2.8 The contract language is German.
2.9 Order processing and contact usually occur by email. The Customer must ensure the accuracy of their email address and check spam filters to ensure communication is received.
3) Right of Withdrawal
3.1 Consumers generally have a right of withdrawal.
3.2 Details on the withdrawal right can be found in the Seller’s withdrawal policy.
4) Prices and Payment Terms
4.1 Unless otherwise stated, all prices are total prices including statutory VAT. Additional delivery or shipping costs are specified separately.
4.2 Available payment methods are shown in the Seller’s online shop.
4.3 If PayPal payment options (e.g., invoice or installments) are used, the Seller assigns its payment claim to PayPal or a designated payment service provider. PayPal may perform a credit check before approval. If refused, the Seller may deny that payment method. Payments can only be made with discharging effect to PayPal.
4.4 For SOFORT payments, the transaction is processed via SOFORT GmbH, Theresienhöhe 12, 80339 Munich. The Customer must have an activated online banking account. More information is available at https://www.klarna.com/sofort/.
5) Delivery and Shipping Conditions
5.1 Delivery occurs within the area specified by the Seller to the address provided by the Customer unless agreed otherwise.
5.2 If delivery fails due to reasons attributable to the Customer, the Customer bears the resulting reasonable costs. This does not apply if the Customer exercises the right of withdrawal.
5.3 For entrepreneurs, the risk of accidental loss transfers once the goods are handed to the carrier. For consumers, risk transfers only upon receipt of goods, unless the carrier was chosen by the Customer.
5.4 The Seller may withdraw from the contract if proper supply from suppliers fails, despite due diligence. Customers will be notified and reimbursed immediately.
5.5 Self-collection is not possible for logistical reasons.
6) Duration and Termination of Subscription Contracts
6.1 Subscription contracts are indefinite and may be canceled by the Customer at the end of any month.
6.2 Extraordinary termination for good cause remains unaffected.
6.3 Termination can be made in writing, by email, or electronically via the Seller’s online cancellation button.
7) Retention of Title
Until full payment is received, the Seller retains ownership of the delivered goods.
8) Liability for Defects (Warranty)
Unless otherwise stated, statutory warranty rights apply.
8.1 For entrepreneurs:

The Seller chooses the type of subsequent performance.

The limitation period for new goods is one year from delivery.

For used goods, warranty rights are excluded.

Renewal does not restart limitation.
8.2 These limitations do not apply to:

Claims for damages,
-
Fraudulent concealment,
-
Goods used in construction causing defects,
-
Obligations to provide updates for digital elements.
8.3 Statutory recourse rights remain unaffected.
8.4 Merchants must comply with inspection and notification duties under §377 HGB.
8.5 Consumers are requested to report transport damage but are not legally obligated to.
9) Liability
9.1 The Seller is fully liable:

for intent or gross negligence,
-
for injury to life, body, or health,
-
under product liability law,
-
or if a guarantee has been given.
9.2 For minor negligence breaching essential obligations, liability is limited to foreseeable, typical damage.
9.3 Further liability is excluded.
9.4 These rules also apply to the Seller’s agents and legal representatives.
10) Redemption of Promotional Vouchers
10.1 Promotional vouchers issued free of charge are redeemable only in the Seller’s online shop within the validity period.
10.2 Certain products may be excluded as stated on the voucher.
10.3 Vouchers must be redeemed before checkout; retroactive application is not possible.
10.4 Only one voucher may be used per order.
10.5 The order value must equal or exceed the voucher amount; unused balance is forfeited.
10.6 Any remaining balance can be paid via another payment method.
10.7 Voucher credit is not paid out in cash nor does it accrue interest.
10.8 If goods purchased with a voucher are returned, the voucher is not refunded.
10.9 Vouchers are personal and non-transferable. The Seller may verify entitlement.
11) Applicable Law
All legal relationships are governed by the laws of England and Wales, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Consumer protection laws of the customer’s home country remain unaffected.
12) Jurisdiction
If the Customer is a merchant or legal entity under public law based in the United Kingdom, the Seller’s registered office is the exclusive place of jurisdiction. The same applies to foreign merchants. The Seller may also sue at the Customer’s place of business.
13) Code of Conduct
The Seller adheres to the participation conditions of the “Fairness in Commerce” eCommerce initiative, available at https://www.fairness-im-handel.de/teilnahmebedingungen/.
14) Alternative Dispute Resolution
14.1 The EU Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.
14.2 The Seller is not obligated but willing to participate in dispute resolution before a consumer arbitration board.
